General Terms and Conditions of Twincruiser Tours Stauffer

Status March 2024

Note: Twincruiser Tours Stauffer is called hereinafter TWC

1a. Registration/Contract/Booking

The contract is created by the participant either verbally, in person, in writing, via e-Mail, or via our website and is confirmed with our written order confirmation. This contract contains and includes rights and obligations which are legally binding for you as a participant as well as for TWC. 

1b. Booking 

TWC take bookings from one to a maximum of 12 participants on a maximum of 8 motorcycles.
For bookings of more than four persons, so called mini-group, you must designate a person that acts for the mini-group. This named person is responsible for all persons on whose behalf a booking is made or any other person to whom a booking is added or transferred.

The named responsible person of the booking agrees on behalf of all persons detailed on the booking that:

  1. She/he has read and did understand our general terms and conditions and has the authority to and does agree to be bound by them;
  2. She/he consents to our use of personal data in accordance with our Privacy Policy and is authorized on behalf of all persons named on the booking to disclose their personal details to us, including where applicable special categories of data (such as information on health conditions or disabilities and dietary requirements);
  3. She/he is over 18 years of age and where placing an order for services with age restrictions declares that she/he and all members of the party are of the appropriate age to purchase those services;
  4. She/he accepts financial responsibility for payment of the booking on behalf of all persons detailed on the booking.

2. Scope and contractual performances and services

Each participant must acknowledge and accept our general terms and conditions before we may issue our confirmation/invoice.
The scope of the contractual performances and services are listed and specified in our confirmation/invoice. Any commitments and agreements, which change the scope of the contractual performances and services, requires a written confirmation from TWC. Any verbal alterations are nil and void unless confirmed in writing and signed by TWC.

The tours are conducted in all weathers. We reserve the rights to propose a replacement program should the weather prevent a route on a particular day or several days. If any additional costs arise, then these are not included in the original tour price and will be charged to the participant accordingly.

If third-party services are merely brokered by TWC, (TWC acting as a mere facilitator), the contract is concluded between the participant and the third-party company. In such cases, TWC is not a contracting party, and the present general terms and conditions are not applicable.
The contractual terms of the respective third party shall apply exclusively. For example, but not limited to, vehicle rentals, flight tickets, accommodations and  excursions that have not been included in our day-by-day itinerary and or program.

3. Rider, pillion passenger, participants and various tours 

The tours displayed on our websites are standard public tours with a set package and itinerary.
The price of these tours is valid for the specified number of riders only.

Should you wish to have one of these tours with a lower or higher number of participants’ and adapted to your requests, then a new price will apply. Contact TWC with your requests.

TWC does only offer tours for people that do know each other.
Most of our tours are private, personal, and tailored to the participants requests.

It is the solely responsibility of each rider  and pillion passenger to determine whether his skills, his know-how, his abilities, including physical (medical) fitness and experiences are sufficient to meet the offered motorcycle tour. Read carefully and take notice of our information on riding skills, total length of tour, km per day and riding hours per day of each specified route.
Neither TWC nor any of its representatives meet an obligation, to check, examine or determine the skills, health, fitness, know-how, abilities and experiences of the participant.

Participants that like to follow their friends in our escort vehicle, if available, are welcomed. 

The participant is solely responsible for his motorcycle, whether it is hired or his own.
Should you join a TWC tour with your own motorcycle, you are responsible that it is in a perfect technical condition, that is has enough tyres profile for the milage of the booked tour and that it complies with all legal requirements needed for each country that the motorcycle tour goes through.
Neither TWC nor its representatives are required or obliged nor have they the abilities, to check, control or examine the fulfilment of these essential conditions. TWC nor its tour guides and representatives can be held or made responsible in any way.
No insurance will be provided by TWC for participants who join our tours with their own motorcycles. For hired motorcycle, refer to the terms and conditions of the motorcycle renting place. See also Point 2!

Appropriate and protective motorcycle clothing and apparel including a safety vest and a suitable rain protection for the chosen tour is expected.
We draw your attention that weather in the higher regions, in the mountains, over the passes and in the Alps can change suddenly. Suddenly means anything within one hour.
In Africa, temperature differences between day and night can easily be between 20-30 degrees Celsius.
The wearing of an helmet is mandatory. The helmet as well as the gloves must be certified and approved by the local laws, (Check the countries on our tour description).
On request, we rent at a small charge motorcycle clothing (gloves, trousers, jackets and helmets). Each bikers feels the most comfortable in his own clothing and especially helmet and gloves, therefore we advise you to bring your own apparel for tours longer than two days.

4. Booking, planning and confirmation/invoice

Upon receipt of your booking, either verbally or in writing, we send you our confirmation with the invoice. With your booking and your first down payment for your tour, you agree that you have read and accepted all Terms and Conditions of this agreement as a binding contract between TWC and you, the tour participant. In addition, TWC requires a duly signed Release and Waiver form to be provided by TWC
We ask you to check the confirmation/invoice (see point 20) and to inform us immediately of any mistakes or faults and to pay the invoice immediately upon receipt.
Only after receipt of the invoiced amount, your place will be secured, and we will start with the bookings and procedures. This money is required to establish and hold your reservation, to pay various expenses ahead of the tour, for deposits and cash prices.
To offer you our tours at these prices, we work out special conditions with our suppliers which need to be purchased and paid in advance.

5. Dynamic, hourly updated hotel, and flight prices

Nowadays the hotels, the airlines and even fuel stations and restaurants use a sophisticated “yield management” system to control the yield of every single room, flight and customer on an hourly base.
Prices are constantly adjusted to the demand; in short, it means that the price of the hotel rooms and flights depends on the number of free rooms and flight seats available at that specific time of the booking, or in case or the fuel stations and restaurants to peak hours.
For that reason, we cannot give you a binding figure until you book firmly with us. Note that with the virus pandemic, the rules, and regulations for entry into all countries around the world and in various regions within these countries may change without notice. This is making it exceedingly difficult for us to control all costs. Make sure, you have the adequate insurance to cover such incidents.

6. Travel, riding, and health documents

Each participant is responsible for his valid travel documents and their validity such as driver license (national and/or international), vehicle documents, green card (where applicable), personal identification card (ID), passport, as well as the visas for the country traveled or transited.
The application and supply of the visas can take several weeks. Therefore, we ask you to procure these documents as soon as possible respectively to control the validity /expiration date. We will gladly help you. A fee will apply, refer to Point 10a.
In our confirmation, we will inform which of the health requirements needed respectively where to find the necessary information.
Participants are solely responsible for the vaccinations, for complying with these named regulations and all consequences resulting from non-compliance.

7. Behavior and violations

Against our terms and conditions, the instructions of the tour guide, against traffic legislation and the law applicable in the country you visit.

TWC cannot be held responsible for any misconduct, wrongdoing or inappropriate behavior of the participants, other participants in the group and/or other road users. Each participant drives on his own and in the context of the respective regulations and laws of the country, through which the route/tour leads. (In South Africa, Ireland, and the UK e.g. is left-hand traffic). Ignorance of traffic laws does not prevent punishment. The person causing the accident is solely responsible, neither TWC nor its representatives can be held responsible is any way for any accidents. Traffic violations will be charged to the respective driver of the vehicle. Neither TWC nor its representatives can be held responsible in any way. In the event of a major violation or if the participant does not practice safe group travel as described or instructed by the tour leader and by the guidelines provided by TWC, traffic regulations or any other rules from the authorities, TWC may withdraw immediately from the travel contract. The participant will have to leave the tour immediately and no refund of the tour price will be considered. The participant is obliged to compensate TWC for any damages whatsoever, for example but not limited to, the return of the hired motorcycle, cancelling of the booked accommodations and restaurants reservations, extra time, and labor costs, etc…

8. Alcohol, drugs, and medication

The 0, 00% BAC (Blood Alcohol Concentration) applies while driving or riding any vehicle.  
While driving any vehicle, TWC will not tolerate any alcohol consumption, nor allow the taking of any medication or drugs that may affect in any way your ability to ride or to drive any vehicle safely.
Participants agree to drink alcoholic drinks responsibly and not to drink any hard alcohols, only beers or wines after the use of any vehicle.

9. Liability

Limitation of liability and disclaimers
Liability for all damages is limited to twice the price of the tour package. Liability is not limited in the case of personal injury or damage caused intentionally or trough negligence.

With your booking or registration, you recognize the dangers in motorcycling sport, motorcycle tours and traveling. Each participant takes part in the motorcycle tour at his own risk. 

Even well-qualified tour guides are not error-free. Each participant declares expressly and irrevocably that he shall not held TWC nor its representatives liable in any way for any occurrence in connection with the operation or participation in the tour which might result in his injury, his death, any illness or damages to his property, his family, his partner, his legal successors, his heirs and/or his assigns.

Motorcycling is a outdoor sport and TWC cannot be held liable for weather and for subjective success which the participant evaluates as such (e.g. wild animals not seen, group composition, road conditions, route choice, accommodations and restaurants choice, itinerary and others,…)
Any claims towards TWC for these or similar cases are excluded.
TWC is not liable for any reduction in benefits that are due to act of God, failure from service providers, war, strikes, terrorist activities or negligence of a participant.
Waiting periods on the tour, due to weather conditions, unavoidable transport (ferry, boat or flight) problem for example delays, customs and excise matters, any congestion, breakdowns or absolutely necessary repairs on the motorcycles, cannot lead to any claims towards TWC or the tour guide. Should a participant not be able to continue the tour, because of his own defective motorcycle and a replacement of his motorcycle is not possible or unsuccessful, then he shall not be entitled to any refund of the tour price paid. A replacement motorcycle is not included in the tour price except for the rented motorcycles. We are not responsible for any loss or damage to your or the hired motorcycle, irrespective of how any damage or loss may have been caused.

We kindly request that you secure all your valuables, including all electronic devices and monies in the safe. Please do not leave any of your valuables unattended at any time. Should there not be a safe in your room, please contact the reception or responsible person of the hotel/guest-house/accommodation. TWC cannot be liable for any loss or damage whatsoever to any participant’s possessions.

10a. Rates, price, price changes and booking fees

The rate of the tour stated as Starting Price per rider is the lowest starting price including the mentioned services with the minimum number of participants in Swiss Francs (CHF) including VAT (Value Added Tax) and other taxes and fees as described in each tour description. That price is correct at the time of the website going live. All details and prices are subject to our written confirmation at the time of the definite booking.

All prices include the services mentioned on our confirmation / invoice and are based on the calculated exchange rate, rental fees, fuel costs and other costs. The cost of the tours quoted are the costs in effect at the time the confirmation / invoice is given.
Meals and à la carte meals exceeding the maximum amount confirmed in writing, as well as drinks, entrance fees, fuel and kilometers driven without a tour guide and other services not mentioned on our confirmation / invoice and itinerary or day-by-day itinerary / program will be charged to the participants during and at the end of the tour or deducted from the deposit “extra costs”. (see point 10.a – Additional products and expenses).
This amount has to be paid immediately in cash to the tour guide.

Prices for joining pillion-passengers are lower as they do not include the costs related to the motorcycle such as rental, fuel, tolls, transport (ferry, one way cost, train, etc.…), garage, etc.
The price per rider is based on two persons sharing one double room including the services mentioned in our confirmation/invoice and includes VAT (Value Added Tax) and other local taxes. Single occupancy room rates are available on request.

All payments either via bank, post or wire transfer require you to pay all associated transfer costs and fees required in order, for TWC to receive the full invoiced amount for all the services offered and purchased.

All tour prices are based on the costs in effect at the time of the publishing on the website.
Our confirmation/invoice is binding but TWC reserves the right to increase the price in the event of changes in the exchange rates, changes in tariffs for transport companies and vehicle rental companies, fuel prices, energy (electricity) prices, government levies or fees (such as value added tax, airport taxes, airport security fees, etc.), extraordinary price increases for accommodation and plausible misprints and tipping errors. 
TWC will communicate any price differences due the above-mentioned reasons by the latest twenty-one (21) days before the motorcycle tour departure date.
The participant has the right to withdraw from the travel contract at no extra costs* within five (5) days, should the total tour price exceed ten (10) percent (%) of the price stated on our confirmation/invoice.

Please note that for some specific documents issued in the names of the participant (e.g., flight tickets already issued, rentals, theaters, and entry tickets to events,) a transfer or a cancellation is not always possible! TWC is not liable for such cases.
* Some exception do apply see 15. Withdrawal or alterations by the Tour Operator and 16. Withdrawal or alterations on the part of the participant.

Late payment will result in costs that you will be charged for.

10b. Additional products and expenses

TWC may in addition to any service or booking fees, charge the participant for the following:

Booking fee
For booked standard packages as published on our website: Minimum CHF 50.- per person, maximum CHF 100.- per booking.
For booked self-drive trips (TWC acting as travel intermediary only) : Minimum CHF 100.- per person, maximum CHF 250.- per booking.
The booking fee is a cost contribution for the product liability, a personal contact person during the booked trip, the safety of your money paid into our account, the support in the event of unforeseen incidents and a 24-hour emergency service. It is valid only if paid into our account 91 days before the tour starts.

Various reservations and inquiries (regardless of whether a booking is made or not)
Reservation for accommodation (hotels, etc.) and vehicle rentals, CHF 100.-. Does not apply to our standard guided packages as published on our website with our tour guide.
Note that hotels are using like airlines, a very complex dynamic pricing software or in our language, a real-time pricing.  These are rates that are adjusted continuously based on the occupancy of the hotel rooms, the demand, the season, and other factors.

Reservation for ferries CHF 50.- plus the costs charged to us by the shipping company. Does not apply to our standard guided packages as published on our website with our tour guide.

Reservation for concerts, musicals, big screen cinema, theater tickets and public events (Open air, Passion Plays, etc.) CHF 55.- plus the fees charged to us by the point of sale.

Procurement of any railway-tickets, per ticket CHF 25.-.

Visa procurement
CHF 100.-/visa plus all invoiced fees to us from the embassy. TWC will procure the visa (s) only on the special written request of the participant and only for tours booked with TWC.

Permits
Specials permits for driving on selected private roads. CHF 25.-/participant.

Travel insurance at the customer’s request
At cost charged to us by the insurance company. These insurances are not available to every participant as they depend on their country of permanent residence.

Post/mail delivery charges
At the cost invoiced to us from the Shipping Carrier of your choice plus CHF 15.-/delivery. Note that we deliver to certain countries only with registered mail and with proof of delivery (signature of recipient).

Money Transfers and Bank charges
All wire, and bank transfers must be marked as “Sender Pays All Costs and Fee’s for transfer”.
Money transfer fees and levies incurred are for the participants account and shall be borne by the participant. Any costs charged to TWC will be invoiced to the participant.

Payments with check
Check-Payments are not recommended, as these are associated with extremely high costs that TWC will charge back to the participant.

Last minute bookings
CHF 100.-/participant and consultations fees at CHF 20.-/ 15 minutes. The first 30 minutes are free of charge. Cancellation costs for last-minute bookings are 100% of the offered price and have to be borne by the participant.

Name changes and corrections on flight-tickets
Any corrections after the flight-ticket have been issued: Minimum CHF 100.- plus the cost of the new flight-ticket issued and any costs charged to us by the airlines.
Flight-tickets can mostly not be changed and if so, very high costs are involved that we must charge fully to the participant.

Name changes, any correction and changes
Any alterations after our confirmation/invoice have been issued will be charged for at the following costs:
A minimum of CHF 100.- plus the cost of the expenses of the various booked third parties (hotels, train-ticket, half-fares tickets, vehicle rentals, ferry, reservations, etc,). Note that some issued tickets and confirmed bookings cannot be cancelled. Refer to our confirmation/invoice.

Tailored tours, private tours and customized self-drive tours and holidays: The planning, organization, creation of the route with a day-by-day itinerary and the booking of the accommodations for tailored tours, private tours, customized self-drive tours and holidays will be charged according to expenditure at the cost of each unit of an half hour. We charge CHF 40.- per unit or broken unit of 30 minutes. The first 15 minutes and the rough offer-version without details, without any bookings and without a day-by-day itinerary are free of charge.
Whatever you did pay TWC for the rough offer-versions (planning and creation of an day-by-day itinerary), will be deducted from your final bill, when you definitely book with us.
TWC acts as travel intermediary.  The service providers exclusively are the contractual partners of the participant regarding the travel services themselves.

Not included are:

– Any items and service not mentioned as included is not included. Refer to our tour description on our website and our confirmation / invoice
– All extra services and / or special requests such as, but not limited to, breakfast in bed or served in the room, extra room service, laundry, any beverages containing alcohol, any drinks ordered from the bar, coffees and teas after the meals, hired vehicles including bicycles, cleaning of dirty hired motorcycle, etc.
– Any insurances
– All expenses of a personal nature

All additional expenses that TWC paid for the participant during the tour must be paid back to TWC before the end of the tour. TWC may ask for an down payment before the start of the tour. If it is not possible to determine with a reasonable effort which participant (s) caused the additional costs, TWC is entitled to charge all the travel participants concerned a lump sum of the estimated amount of the costs incurred by them, under the joint and several liability of all concerned participants. TWC is under no obligation to furnish any kind of a breakdown of the costs involved in a tour.

11. Terms of payment and travel voucher

With your registration or booking, the participant will receive an invoice for the advance payment over a minimum of 50% of the total tour price. The payment for this invoice is due immediately. The remainder of the invoice amount is due 99 working days before the start of the tour.
For self-guided tours, we request full payment in advance.
On last minute registration (not always possible), i.e. less than 31 days prior departure, the entire invoice amount is payable immediately. For one-day tours, the payment is due immediately at the registration of the tour.
Only participants that have fully paid the total amount due before the start of the tour are taken on the tour.
Anyone subscribing, opening and reading our newsletter for a minimum of five years, will get a voucher of a CHF 100.- on his first booking of a tour-package with tour guide of a minimum value of  CHF 2’000.- as published on the website. The voucher will be deducted off your expenses during the tour with TWC. No cash refund.

12. Delivery of  the travel documents

All travel documents (like for example, info package, day-by-day itinerary, itinerary, program, etc..) as mentioned in our confirmation/invoice will be sent to the participant at the latest two weeks before the departure date of the tour and only after receipt of your full payment in our account.
These documents will be sent to the participant via the official post by registered post. The participant may choose a different shipping carrier, this has to be communicated to us in writing immediately after the receipt of the first invoice. The participant is fully responsable for the collection of our documents. Any incurred expenses must be borne entirely by the participant, whatever the amount. 
Flight tickets will only be booked and purchased after receipt of the full payment of our invoice.

13. Loss of travel documents

We cannot accept liability for loss of travel documents. We recommend each participant to copy all his travel documents and to store them at separate places. For example, one set in paper form with your personal documents, (passport, ID, etc…) as well as your money in cash and credit cards and one set in your suitcase or travel bag and a third one, digitally in your cloud.

14. Insurances

Participants are not insured by TWC
The participant is liable for his own insurances. For example but not limited to, travel-, out-of-country accident- and health-insurance, illness / medical expenses, emergency medical evacuation, legal expenses-, personal assistance-, luggage-, travel costs, travel cancellation costs, motorcycle and property damage insurance.
TWC strongly advises you to check your current insurances and recommended for your own self-interest and protection that you have adequate insurance to cover these eventualities.
Depending on your nationality and kind of coverage, TWC can at a cost, do this for you, where possible (depends on the country and the country of origin of the participant).
Note that many countries have a requirement for foreign visitors to have a valid medical insurance on entry. TWC cannot be held responsible if a passenger is denied entry into that country for being unable to provide details to the authorities of such insurance.

15. Withdrawal and / or alterations by TWC 

TWC reserves the right to change, adapt or cancel at short notice the tour or part of it, for any general weather conditions, local weather and for safety reasons. The prices mentioned on our website is calculated and based on a minimum number of participants. This is mentioned in the tour description and in our offers. Should your group not reach the minimum number of participants mentioned, contact us and we will work out a new price for you.

TWC will offer any tour within our range, knowledge and experience with the number of participant interested.
TWC may cancel a tour at short notice for reasons like riots, unrest, war, strikes, terrorists act, act of God, natural disaster (e.g. sudden snow falls, volcano eruptions, earthquake, major storm,…) and any other circumstances that TWC may consider as life endangering or unsafe.
Further in the unlikely event of injury or illness of the tour guide either shortly before or during a tour, TWC may cancel or stop the tour should they not be able to find a reasonable replacement.
In all these cases, TWC  will refund all payments received in our account less any services and / or expenses already rendered (e.g. paid flight tickets, paid train tickets, vehicle rental including support vehicle rental, salaries paid in advance, motorcycle rentals, hotels, restaurants, administration and booking fees, etc…). TWC may also offer a replacement tour. Any other or further claims are excluded.
TWC is not liable for any additional costs (such as hotels, meals, taxis, flights, etc.), should the dates or the time of the start and / or the end of a tour be moved or delayed through force majeure*.

16. Withdrawal or alterations on the part of the participant

The participant is entitled to withdraw at any time from the confirmed tour. However, the deposit or advance payment is still owed and will be used for incurred costs and services.
The following amounts will be refunded in case of a cancellation or withdrawal from the travel contract:

  • From date of registration until 95 days (for tours in Switzerland and Europe) and 128 days (for tours outside of Europe and Switzerland) before the starting date of the tour: 35 % of the down payment respectively amount received in our bank account in form of TWC vouchers.
  • From 94 days until 32 days (for tours in Switzerland and Europe) respectively 127 days until 61 days (for tours outside of Europe and Switzerland) before the starting date of the tour: 50% of the tour price in form of TWC vouchers.
  • From 31 days before the starting date of the tour or when not at the start of the tour, so called No Show 0% of the tour price.

A cancellation or withdrawal from the travel contract must be sent to TWC in writing by registered post. The cancellation of the travel contract is considered as accepted when TWC has confirmed it in writing.
The above-mentioned periods refer to the date, when TWC is in possession of the registered letter. The amounts that will be refunded are stated above. The participant is not entitled to any refunds, claims or compensations should he not appear to the agreed tour, take only limited part of the services of the tour or leave the tour at any time.
Should the participant exceptionally not be able to begin the tour, he may designate a replacement participant. A so called, transmission of the travel contract shall take place. The replacement tour participant must confirm in writing that he is taking over the existing travel contract and conditions and that he will be liable for the full price of the tour.
Replacement tour participants can be designated up to 130 days before starting date of the tour. All issued documents and travel information in the possession of the original tour participant are to be returned immediately to TWC.
The participant may not assign or transfer his rights or the travel contract to another person without the explicit written permission of TWC.
TWC will invoice handling and administrations fees for travel contract alterations, any changes to the agreement and for travel contract transmission. Note that for some specific documents issued in the names of the participant (e.g., airline tickets and railway passes,…) a transfer is often not possible and are subject to cancellation fees imposed by the airline or the railway company or its agent or intermediary. 
Transfers, theatre and any other entertainment tickets and packages (e.g., where the admission/entry tickets is in a combination with other services like accommodations, meals and transfers) are non-refundable once issued or purchased.

For special tours, such as all motorcycle events (Wheels and Waves, European Bike Week in Faak am See, Isle of Man TT and Classic TT, HOG Rallyes,…) as well as private, respectively tailor-made tours the cancellation conditions of this point 16 are not applicable. Should you cancel the booked tour, 100% of the tour price plus handling fees and all expenses will be charged. 

17. Claims and complaints

Claims, objections, shortcomings, or complaints which are not mentioned in writing during the tour to TWC will not be considered at a later stage.

18. Photos, films, and videos

The participant agrees to the publication and storage of pictures, films and videos taken during the tour even if the participant is recognizable on them. The participant does not get any compensation for this. Please inform TWC in writing before the start of the tour should you disagree with this procedure.

19. Vehicle rentals

The hired vehicles (motorcycles, buses, or cars) are insured by the insurance company of the hiring service provider (not TWC) according to the law of the specific country, you rent the vehicles.  The exact coverage is stated in our confirmation and invoice. Please make sure that you have chosen the appropriate insurance coverage to avoid unwanted surprises and high expenses. We are here to help you and to advise you on the optional insurance’s coverage!
In general, we advise to cover the following:

  • Motorcycle limited liability insurance that covers third-party claims for damages. This is compulsory in most countries also in Switzerland. This insurance does not cover damages to your rented vehicle nor to you personally in case of an accident.
  • Comprehensive or fully comprehensive (“casco”) insurance that covers first-party damage (your rented vehicle) to the vehicle. These insurances are linked with a deductible according to the booked motorcycle model. The participant will only loose his damage deposit (also called excess) in case of a claim (depending on the service provider the amount can vary between CHF 1’000-5’000.-). This amount is secured at the beginning of the rental via the participant’s major credit card or in cash. (Check your Credit Card, Diners Club and American Express are mostly not accepted).

Please contact us as soon as possible and before the start of the tour should you wish a better or another insurance.

The minimum age for renting a motorcycle is 25 years.
TWC does not assume any liability for the offers and services for hired vehicles. Only the General Terms and Conditions of the service provider (renter of the vehicle) shall apply.
As all vehicles are rented with a full tank, we expect you to return the vehicle only with a full tank. The refuelling option offered by the renting companies is  awfully expensive. Fuel (petrol, gas) prices for vehicle in Europe are up to triple of the cost in the US and is sold by the litre (1 US liquid gallon = 3.78 litres).

Note also that you are solely responsible to control the conditions of the vehicle at take-over, therefore a few tips:

Before you drive/ride out of the rental place, check and inform the personnel of the renting company of any discrepancies and take photos of the vehicle from all angles, also from underneath. This is your personal ‘insurance’ against being charged for previous damages to the vehicle. Make sure the time/date on your camera is set right at the local time.

Check the tires conditions and pressure and the brakes.

Should you return the vehicle excessively dirty (for car and buses on the inside too), you might be charged for a cleaning fee. Clean, remove trash and sweep out sand or dirt before returning.

Take again photos upon return from all angles. Don’t let yourself stress, take your time and let the agent check and sign for the vehicle. Again this is your ‘insurance’ against being charged for damage you didn’t incur.

TWC is not responsible for the replacement of a vehicle (car, bus, motorcycle, etc…) damaged by the participant or in an accident and, in such cases, the participant shall not expect such replacement. See also paragraph 2.

20. Mistakes, inaccuracies, updates and alterations

TWC reserves the right to update and/or alter these terms and conditions at any time and without prior notice. The latest terms and conditions which supersedes any previous versions can be found on our website under this link. It is the participants responsibility to be familiar with our terms and conditions.

Each participant is asked to check immediately and in his own interest, that all documents, (offer, confirmation/invoice, etc) and receipts handed over to him are correct at the time. Should the participant discover errors or contradictions, TWC must be informed immediately in order to avoid any damage and costs.

Any gender includes the other genders
A natural person includes a juristic person and vice versa
The singular includes the plural and vice versa
The terms you, travel participant, participant and customer refer to the user or the viewer of our website
The term tour is the tour, you have chosen from our websites or on our brochure or that we have offered
The terms, Twincruiser Tours, TWC, operator, tour operator or us, we or our, refers to the owner of the website and the company Twincruiser Tours Stauffer and includes all his staff 
Force majeure means unforeseeable circumstances that prevent someone from fulfilling a contract

22 Severability

If any provision of these General Terms and Conditions is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.

23. Applicable law and place of jurisdiction

Swiss Law shall be exclusively applicable.
No matter which nationality the participant possesses and where the damage or claim took place.
The sole place of jurisdiction is Bern – Switzerland

24. Translation of these terms and conditions
